Postanowienie Sądu Apelacyjnego w Szczecinie z dnia 10 maja 2017 r., II AKzw 544/17: glosa
AbstractThe commented judgment concerns the problems of conditions taken into account by a penitentiary court when examining a convict’s application to be allowed to serve the custodial sentence in the Electronic Tagging System, which conditions are listed in Art. 43la(1)(2) of the Criminal Punishment Code (purposes of the sentence) and in Art. 43la(2) of the Code (assessment of the degree of demoralisation). An inerpretation of the Code’s provisions in this regard leads to numerous contradictions of systemic nature, some of which the court observed. The commentator’s objective is to emphasise, on the basis of the analysed judgment, the most important and pivotal problems concerning the practical application of custodial sentences using the Electronic Tagging System.
