Constitutional and legal aspects of gene editing in Poland

Tomasz Pietrzykowski , Oktawian Nawrot

Abstract

The system of bio-law in Poland is still incomplete and incoherent. Arguably, the use of the very notion of the system in this respect is not fully justified. Most issues that are the ethically and socially sensitive outcomes of the developments in biology and medical sciences remain beyond the scope of legal regulation, while the rules that are actually established often turn out inadequate in the face of a rapidly changing reality. In many cases they seem merely to legalise the already established facts or to give rise to serious constitutional concerns.
