The status of judges depends greatly on the system of safeguards guaranteeing proper exercise of judges’ rights, and proper discharge of their duties. One of the special institutions connected with the above is the National Council of the Judiciary. This is particularly visible in those exceptional situations when ideological and systemic changes take place. Then, a lot depends on how the National Council of the Judiciary is involved in this process - according to statutory law and thanks to the personal attitudes of Council members. The current developments in Poland are a good example. They should also be the impetus for reflections both on what the independence of judges and courts means now and what should it should mean, and on why the issue repeatedly causes heated debates.
