The role of guarantee institutions in protection of road accident victims in EU
AbstractGuarantee Schemes provide last-resort protection to consumers when undertakings are unable to fulfil their contractual commitments. However, there is no such common European framework in the insurance sector. But the EU law imposed an obligation on the Member States to establish guarantee bodies with expertise in the area of meeting the legitimate claims of road accidents victims by the perpetrators, whose liability is not protected, and unidentified perpetrators. This provision determines the obligatory nature of the so-called communication guarantee funds operating in the European Union. The aim was to “seal” the road accident victim protection through institutional protection in situations of lack of protection from the insurer. Currently consolidated communication directives indicate that the intention of the EU legislator is to “seal” the system of road accident victim protection by guarantee institutions. The EU motor insurance guarantee schemes can be a model for Insurance Guarantee Schemes.
