Polskie doświadczenia w zakresie ogłaszania prawa
AbstractThis article discusses the Polish experience in the area of promulgating laws, with special emphasis on controversial cases. It covers the period from 1918, when Poland regained independence, onwards. The author analyses not only the practice of the authorities in charge of promulgating law, but also the key court decisions in these matters. The analysis leads to the conclusion that the way the duty to promulgate normative instruments is discharged illustrates the condition of the rule of law. In the periods when the idea of the rule of law lost its importance, the authorities responsible for promulgating the law manipulated with thepromulgation of laws in order to achieve specifi c political goals. The author concludes with the postulate of amending the applicable provisions in order to cover the acts connected with promulgating laws with the jurisdiction of administrative courts.
